Lodging of Complaint Against Unfair Business Practices

Overview

Any consumer whose interests/rights are violated and having not obtained redress from the business may lodge a consumer complaint of unfair business practice.

A consumer is defined in the Consumer Protection Act 2018 as “any person or non-profit making organisation to whom or to which any commodity is offered, supplied or made available, where such person or organisation does not intend to apply the commodity for the purpose of resale, lease, rendering services or the manufacture of goods for gain."

 Any consumer, class of consumers or consumer organisation.

  • Seek redress from the supplier concerning your dissatisfaction with the service rendered. 
  • If dissatisfied escalate to the nearest Consumer Protection Offices listed below by: 
  • Downloading and submitting the CONSUMER COMPLAINT FORM with supporting documents in person or fax.

Liquor Licence Application

Overview

A company or an individual must obtain a liquor licence in order to legally sell alcoholic beverages to the public. A separate liquor licence must be applied for each location where alcoholic beverages are sold, even if they are sold by the same company or individual. The proposed business premises should be at least 500 meters away from a school, church, highway, or major road.

Who is eligible?

Citizens and non-citizens who are above the age of 18 years and businesses qualify for the following licenses:

  • Distributor liquor licence
  • Club liquor licence
  • Temporary licence
  • Wholesale liquor licence

Citizens who are above the age of 18 years and registered businesses owned by citizens of Botswana qualify for the following licences : 

  • Bar liquor licence;
  • Bottle store liquor licence;
  • Liquor depot licence;
  • Nightclub/ Discotheque liquor licence
  • Temporary liquor
How do I get this service?
  • Download, complete and submit the appropriate application forms:
  1. Application for Liquor licence – Initial application of liquor licence.
  2. Notice of application for a Liquor licence – Completed by all applicants to publish their intention for application for liquor licence in any newspaper or the government gazette. The publication is at the applicant’s own cost.
  3. Application for the Renewal of licence – This is for the renewal of the license, which is required annually.
  4. Application for Transfer of a licence – To transfer the liquor licence to another individual or company, or to notify of the change in operating location.
  5. Application for a Duplicate licence – To apply for a new licence after the original has been lost or destroyed subject to the submission of a valid police report.
  • Submit relevant documents and fees shown below to the Town/District Council commercial offices (see attachment of office contact information).
  • Once these documents have been received, the application will be processed and forwarded to the Liquor Control Authority for consideration.
  • The applicant will be notified of the result of the application via mail, SMS, or phone call.
  • If the liquor licence has been approved, the applicant can pick up the licence from the District Council commercial office upon payment of applicable licence fees.
  • On or before the anniversary date of the licence grant, the applicant has to submit Form 4 Application for the Renewal of Licence and pay the renewal fees shown below to the District Council
What supporting documents are required?

First time applications:

  • If the applicant is a business, a certified copy of the certificate of incorporation.
  • If the applicant is an individual or a partnership, submit a certified registration certificate.
  • The latest copy of the annual returns form obtained from the Registrar of Companies and Intellectual Property.
  • Proof of availability of the business premises (either a title deed, or a written lease agreement).
  • Proof of advertisement in Botswana Government Gazette any newspaper in the form of a stamped receipt.  The Liquor Control Authority shall not consider an application for a licence where the notice to apply for a liquor licence has not been published for at least 21 days. 
  • Certified copy of National Identity card (Omang) for owners, shareholders or directors who are citizens.
  • Certified copy of passport, work and residence permit for owners, shareholders or directors who are non-citizens.
  • The original or certified copy of physical planner’s report validating zoning for the plot upon which the activities will occur. Physical planners are employed by the District Council and should be booked by the applicants to validate zoning.
  • The original or a certified copy of the environmental health report for the business premises in question. The report must be completed by health inspectors employed by the District Council and the applicant must book the health inspector for inspection.

Renewal or transfer of licence:

  • Certified copy of valid National Identity Card (Omang) for owners, shareholders or directors who are citizens.
  • Certified copy of passport, work and residence permit for owners, shareholders or directors who are non-citizens.
  • The original or certified copy of physical planner’s report validating zoning for the plot upon which the activities will occur. Physical planners are employed by the District Council and should be booked by the applicants to validate zoning.

Registration of a Co-operative Society

Overview

A Co-operative Society is an autonomous association of persons who voluntarily come together to meet their common economic, social and cultural needs and aspirations through a jointly owned and democratically controlled enterprise.

Who is eligible?
  • Group of ten (10) people or more, aged eighteen (18) years and above, for all other types.
  • Group of twenty (20) people or more, aged eighteen (18) and above, for Financial co-operatives.
How do I get this service?

Visit the Co-operatives office in your locality and submit an application for registration made to the Director on the application form for co-op which shall be signed by all members.

  • If satisfied that the society has met all the requirements and approves registration, the Director shall issue a certificate of registration to the society together with a certified copy of the bye-laws. 
  • If the Director refuses to register a society, he/she shall give reasons for the refusal in writing to the applicants. 
  • If not happy with the decision of the director, lodge an appeal with the Minister within one (1) month. The Minister’s decision on the appeal shall be final.
What supporting documents are required?
  • 3 copies of bye-laws [i.e. rules set by the members in order to guide in carrying out the day to day activities of a Co-operative Society, formulated prior to registration and must be in line with the Co-operative Act] written in English
  • A report on the viability of the proposed Co-operative which shall be in the prescribed form

Economic Diversification Drive (EDD) Registration

Overview

Implementation of the Economic Diversification Drive (EDD) Short-term Strategy and the EDD Medium to Long-term Strategy is designed to coordinate all efforts aimed at diversifying the country’s sources of economic growth and income in such a way that the country becomes more or less equally dependent on all sectors of the economy. In that regard all Central Government, Local Authorities and Parastatal Organizations are required to purchase locally manufactured products and services. Therefore eligible enterprises must register for the Economic Diversification Drive (EDD) initiative to benefit from tenders from these institutions/organizations.

Who is eligible?

Enterprises registered in Botswana and in operation engaged in manufacturing, service provision (excluding agents/ distributors/retailers/resellers/ suppliers and works/construction) and agricultural production.

How do I get this service?
  • Pay application fee at MTI offices.

  • Fill in all the required fields/details in the application form and submit.

  • The office will contact you with further details regarding the application.  

  • If approved, pay issuance fee and collect EDD Certificate.

What supporting documents are required?
  • Proof of payment of application fee.
  • Copy of the certificate of registration and / or incorporation certificate.
  • Most recent financial statements (balance sheet and income statement).
  • Audited financial statements, for those enterprises with an annual turnover of P500 000 and above.
  • Projected financial statements for enterprises that have been operating for less than a year
  • Certified copy of current valid relevant license or registration certificate from a competent authority, (for manufacturing/industrial/trade license/registration certificate, attach the copy of the receipt for annual fee).
  • Unregulated activities must attach a printout of relevant PPADB codes.
  • Copy of valid Tax Clearance Certificate and/ VAT registration.
  • Affidavit confirming that the enterprise is operational, when it started operations, location of operation and products/services currently produced/ offered.

  • Download,  complete and submit CONTROL OF IMPORTS APPLICATION FOR IMPORT PERMIT  OR  APPLICATION FOR AN IMPORT PERMIT BREAD LOAVES AND PIE PASTRIES (reg. 4(2)) at the Department of International Trade with assistance of an officer.
  • In case of importation of some industrial food staff or beverages not existing in the SACU market there is a need to bring a letter of consent from Ministry of Health and Wellness. For other SACU market non existing industrial products, there is a need to bring letter of Standards approval from Botswana Bureau of Standards (BOBS).
  • Pay an application fee before the permit is issued.
