Trade Unions Registration

Overview

Trade Union and Employers Organisations Act: Section 6 (1), explains that every Trade Union formed in Botswana, shall within twenty-eight (28) days immediately after its formation, apply to the Registrar of Trade Unions and Employers Organisations for registration.

What supporting documents are required?
  • Three original copies of the Trade Union’s constitution
  • A copy of resolution of formation
  • A list of full names of all members of the Trade Union
  • A list of full names of executive officers
  • A written statement detailing the following:     1. Name of the Trade Union.   2.Postal address and location of its office.    3.Date of its formation.    4.Titles, full names, ages, occupations, and postal and residential addresses of the officers who signed the application.    5.Minutes of resolution to form union.

Overview

Workplace inspections are done as routine or spot checks to ensure compliance with labour legislation, regulations and International standards.

 

Routine inspection

A routine labour inspection is conducted on a day to day basis to check general compliance in the workplace.

 

Spot check inspection

This type of inspection is conducted in response to a specific reported alleged contravention. Employees or employers can request a spot check.

Societies Registration

Overview

This service registers non-profit making societies and non–governmental organisations. These include:

  • Religious Organisations
  • Professional Associations
  • Burial Societies
  • Recreational and Sporting Clubs
  • Political Parties
  • Charitable Organisations
  • Others
Who is eligible?

All citizens, residents, or visitors who form a society with at least twenty members are eligible for this service.

How do I get this service?

In order to access this service, applicants must complete the following steps:

  • Submit a letter of intent and relevant documents (listed below) to the local Civil and National Registration offices (contact information listed below)
  • Upon receipt of the letter of intent, the Registrar will send the following to the applicant(s) for completion:
  1. Form A to be completed in triplicate
  2. Membership list
  3. Guidelines for forming the Society’s constitution (3 copies to be submitted)
  4. Complete and submit the above three items to the local Civil and National Registration offices
  5. After successful screening of the submitted documents, the Registrar will issue a certificate, Form A and the constitution as approved by the society
What supporting documents are required?
  • Letter of intent to form a society
  • Minutes of the formation of the society with three or more objectives
  • List of signatures and national identity numbers of attendees at the formation of society meeting
  • Ten suggested names for the society in order of preference. The names should be reflective of the nature of the society whether it is an association, club, church or society
  • In case of non-citizens serving on the executive committee, provide the following:
  1. Certified copies of resident permit
  2. Certified work permit
  3. Certified copy of page 1 and 2 of passport, showing their picture and personal details should also be submitted

Fourteen (14) days to complete.

Overview

The exemption certificate is issued to applicants who hold a Permanent Residence Permit.Only Directors are eligible to apply for this Labour Exemption Certificate to work or operate a business in Botswana.

How do I get this service?

 Fill and submit the following forms depending on type of applicant:

  1. Two copies of Form 4 for employees
  2. Two copies of Form 4, Form II/Form 8, Form 13 and Form 14 for directors
  3. Form 3A, Form 15, and Form 21 for all applicants
  4. Submit payment and application forms to the Department of Immigration and Citizenship (address provided below).Check the outcome of your application from the Office which the application was made after 6 Months.
What supporting documents are required?

Requirements applicable to all persons:

  1. Covering letter from the applicant
  2. Two copies of certified passport
  3. Two recent passport size photos
  4. If married, include one copy of certified marriage certificate

 

Immigrants/dependents/missionaries

  1. Letter of support from sponsor, spouse, supporter, or mission
  2. Proof of means of support in Botswana
  3. Most recent month’s bank statement

 

Employees

  1. Curriculum vitae
  2. One copy of certified educational certificates
  3. Reference/confirmation of employment by the employer

 

Investors

  • Wages sheet of employees
  • Duration of employment and certified copies of identity cards for employees who are citizens of Botswana
  • Submit certified copies of the following:
  1. Valuation of shares.
  2. Share certificate.
  3. Certificate of incorporation.
