Default Judgements

Overview

In a civil case, a plaintiff may apply for a default judgment where the defendant has not filed an appearance. Judgement may be entered against such party.

Who is eligible?
  • Plaintiff in case or other non-criminal disputes involving damages of more than BWP60 000.00 at the Magistrate court 
  • Any individual or organisation involved as a plaintiff in a High Court case is eligible to apply for a default judgement following the failure to appear by the defendant in a civil case.
How do I get this service?

  • Once the defendant has failed to appear at the set court date or enter a defence within the allotted time, an applicant can request a default judgement by filing one of the application for judgment in default most relevant to the situation involved (as outlined below). 
  • The application form is to be submitted to the Registrar of the High Court/ Magistrate

What supporting documents are required?

The applicant should file one of the following forms depending on the situation:

  • Applicant is requesting award in monetary terms for specified amount or an amount easily ascertainable with interest. Application for Judgment in Default -Demand Liquidated.
  • Applicant is requesting award for damages in an amount to be determined by the court. Application for Judgment in Default - Demand unliquidated.
  • Applicant is requesting a return of goods in possession to the plaintiff or monetary equivalent .​ Judgment in Default - Detention of Goods ​.
  • Applicant seeks to recover possession only of land currently held by the defendant.  No monetary awards for damages. Interlocutory Judgment in Default – Lands, Damages and Costs (Form 33).
  • Applicant seeks to recover possession only of land currently held by the defendant.  No monetary awards for damages. ​Judgment in Default – Recovery of Land Only (Form 34).
  • Applicant is requesting an award in cash for damages as in the initial case filing for damages with interest.  This is for situations where the defendant has failed to appear at every court date. Request for Default Judgment.

Deputy Sheriffs, Court Bailiffs (Messengers of Court )

Overview

Deputy sheriffs, court bailiffs and messengers of court are court officers appointed by the registrar of the high court.

Deputy sheriffs are appointed for the high court, whilst court bailiffs  are appointed for the magistrate’s courts.

What Are Their Duties?

  1. To serv​​e court processes and perform other functions as provided for under the rules of the high court and magistrate courts.
  2. Serving writs of summons, provisional summons, petitions, applications and warrant of arrest, etc.
  3. Deputy sheriffs are also responsible for enforcing and executing orders of the courts e.g through effecting attachments, advertising sales in execution and executing writs through public auctions of movable and immovable properties.
  4. Also responsible for enforcing court orders and warrants for civil imprisonment.
  5. They can also through the prescribed process be engaged to serve court processes from foreign jurisdictions.

Where do I find these Deputy Sheriffs?

  1. Are expected to act independently.
  2. They act as agents of the court, and not of either party to the judgement.
  3. They are by law expected to report and account to the Sheriff for the proper discharge of their functions.
  4. Deputy sheriffs are each appointed to specific districts in which to operate. These territorial jurisdiction specific appointments are intended to provide citizens with better access to their services and to ensure fair distribution of work amongst these officers. ​​​

How do I recognize them?

  1. Deputy sheriff is given an ID card containing his or her particulars and photo. When executing their duties as an officer of the court, the Deputy sheriffs are expected to display the ID.
  2. Court bailiff  are appointed and regulated through the Public Service Act. This specific category of employees is mostly predominantly operating in Magistrates Courts throughout the country.

Are Deputy Sheriffs allowed to prepare summonses for members of the public?

  1. Deputy Sheriffs are messengers and officers of the Court. In that sense they do work for the courts and the public.
  2. They are not expected to operate like lawyers. It is not their duty to prepare summonses on behalf of members of the public.

Is a deputy sheriff allowed to represent a person in court?

A deputy sheriff cannot represent a person in court as he is not a lawyer.

Are deputy sheriffs debt collectors as well?

  1. Deputy sheriffs are not appointed to operate debt collection companies.
  2. Although they collect debts on behalf of judgment creditors they are not debt collectors in the sense of running debt collection business. They are officers of the court who will only collect debts pursuant to a judgment of the court.

How do a deputy sheriff/court bailiff  recover money owed?

A deputy sheriff is given instructions by the party who won the case (at times referred to as the Judgment Creditor) to enforce the order of the court made in that party’s favour. This could take numerous forms, such as obtaining, removing or selling at auction property of the party who lost the case (also known as the Judgment Debtor).

Assessment of Security Costs

Overview

Pending the outcome of the case by another litigant, the Registrar of the High Court  and the Court of Appeal may assess the amount of the security to be held by the Court. 

Security assessed is held to secure potential costs of the party claiming entitlement to costs pending the outcome of the case.

Who is eligible?

Any party entitled and desiring to demand security in case at the High court/ Court of Appeal can apply for an assessment of security.

How do I get this service?
  • Following the commencement of proceedings in a case at the high court, a party interested in obtaining security must submit a written notice to the Registrar of the High Court/Court of Appeal location at which the case is to be heard outlining the reasons for requesting security and the amount requested. 
  • The Registrar will then assess the validity of the claim for security and the amount and provide directive on the manner of payment.
  • If the amount being requested is contested by the other party, the Registrar shall make the final decision on the amount to be given.
  • If the other party disagrees with the need to provide security or does not pay the amount ordered within ten(10) days of the Registrar’s decision, the party demanding security may request that the judge  halt the proceedings until the amounts are paid.
  • If payments are still not made, the judge may strike out any pleadings made by the party refusing to pay or take other actions as necessary.
What supporting documents are required?
  • Submit a written notice to the Registrar of the high court (if pending appearance before a judge) or to a Judge of the high court/ Court of Appeal  
  • The notice must outline the reasons for requesting security and the amount requested.

One(1) to three (3) months depending on court dates available.

Assessment of Damages

Overview

This court service determines the amount payable as compensation for value of goods or damages suffered by an Party in a case at the Magistrate Court and High Court.  Assessment is  usually done  for unliquidated damages or the value of goods. It is usually done by application which is accompanied by evidence justifying the damages or value. 

Who is eligible?
  • Any party who is part of the proceedings  before court may qualify for an assessment of damages. 
  • The party must have been awarded the right to damages, hence the court case.
How do I get this service?
  • Following the filing of a summons/application to the high court /Magistrate Court if judgement is entered in default of appearance by the defendant, the application is made ex parte. 
  • The application must provide sufficient details to allow for easy identification of the case.
  • Submit an affidavit supporting the truthfulness of the application for assessment of damages.
  • The Registrar/Clerk  set a date for matter to determine the assessment of damages.  Additional evidence may be requested in making this determination.
  • A hearing is undertaken to asse​ss damages on the date set by the Registrar/Clerk.
  • Following the ruling of the registrar/ Clerk, the plaintiff has fourteen (14) days to apply, in writing, for a reassessment of the damages by Judge/Magistrate.  If this is not done, the assessment becomes final.
What supporting documents are required?
  • Written application requesting a date for an assessment of damages.
  • An affidavit establishing, supporting and justifying the damages sought.
How long will this service take?
  • Judgement in default  of appearance within three (3) months
  •  After the conclusion of the hearing, Judgement is passed within six (6) months. 
  • The timing is dependent upon the dates set in consultation with the parties involved either by the the Registrar or Clerk.
